Hazardous Waste: Venezuela's Current Regime That Every Company Must Know

This is the fifth article in a series on Venezuelan environmental law applied to investment projects. The previous four covered the regulatory framework, the Environmental and Sociocultural Impact Assessment (ESIA), the Land Occupation Authorization (AOT), and the role of the registered environmental consultant. All reached the same conclusion: environmental assessment is the legal and technical backbone of any project in Venezuela. This article adds another angle: what to do with the materials and waste already present in the plants being reactivated, and with those the new project will generate.
The consequences fall on three actors. On the investor, as environmental liabilities and penalties. On the lawyer, who must master the operational liability regime. And on the technical professional, who carries registration and reporting obligations that cannot be delegated.
What Is a Hazardous Material or Waste?
A hazardous material is any substance or mixture that, by its physical, chemical, or biological characteristics, may harm health, property, or the environment. It becomes hazardous waste once it loses its intended use and must be permanently eliminated or disposed of. The specific classification follows the United Nations systems and the applicable technical regulations.
Why This Matters Now
The productive reactivation Venezuela is experiencing in 2026 is driving projects in sectors that, by their nature, generate hazardous materials and waste: oil and gas, mining, chemical manufacturing, power generation, and agribusiness. An oil-extraction project produces drilling muds. A mine generates tailings and heavy-metal residues. The production, formulation, sale, or distribution of crop protectants or fertilizers involves substances the law classifies as hazardous. Even empty containers holding residues are, by legal definition, hazardous waste subject to the same regime.
In that context, the hazardous materials and waste regime is a structural part of environmental compliance. An investor that designs a project without building it in from the planning stage builds on an incomplete foundation.
The Regulatory Framework: How Decree 2,635 and the 2001 Law Coexist
Two instruments govern the matter. The first is Decree No. 2,635 (Official Gazette No. 5,245 Ext. of August 3, 1998) ("Decree 2,635"), on the control of hazardous materials and the management of hazardous waste. The second is the Law on Hazardous Substances, Materials, and Waste (Official Gazette No. 5,554 Ext. of November 13, 2001) ("2001 Law"), which regulates generation, use, collection, storage, transport, treatment, and final disposal.
The 2001 Law did not expressly repeal Decree 2,635. Its Second Transitory Provision keeps prior regulations in force—to the extent they do not contradict the Law—until the corresponding technical regulations are issued, which has not yet happened. Decree 2,635 therefore operates as subordinate technical regulation: it is the text that determines, in practice, how the obligations under the 2001 Law are met.
Who It Applies To: A Broad Universe of Obligated Parties
The 2001 Law applies to any natural or legal person, public or private, that holds, generates, uses, or handles hazardous substances, materials, or waste—whether in industrial, commercial, scientific, or medical activity. The origin, domestic or imported, is irrelevant: what matters is the activity and the material. Health facilities are also subject to specific rules for classification and management.
Decree 2,635 identifies four categories of obligated parties the project must understand precisely:
- The generator: produces the hazardous material or waste as a result of its activity. It is the first link in the chain and bears the greatest responsibility.
- The transporter: moves the material between the point of generation and the treatment or disposal site. It must meet identification, documentation, and emergency-plan requirements.
- The storer: temporarily keeps the material under controlled conditions. The maximum storage time is regulated.
- The final-disposal operator: treats, eliminates, or confines the waste. It requires express authorization from the environmental authority.
Several conditions may coexist within a single project: generator, storer, and, in certain cases, treatment operator. Each carries its own obligations, which are not transferred by contract. The generator is not released from liability merely by hiring a third party for transport or disposal.
The Main Obligations
The 2001 Law and Decree 2,635 impose a set of operational obligations the project must build in from the design stage:
- Registration with the environmental authority. Anyone who generates, uses, or handles hazardous materials or waste must register in the Registry of Activities Capable of Degrading the Environment, administered by the Ministry of the People's Power for Ecosocialism ("MINEC"). Without that registration, the activity has no legal cover.
- Identification and classification. Materials and waste are identified under the United Nations systems, updated when technical advances or international treaties ratified by Venezuela so require.
- Emergency and contingency plans. The generator and the transporter must design and implement them under the technical regulations. The transporter must carry them together with the material safety data sheet, the dispatch guide, and the insurance policy.
- Controlled storage. It must prevent hazardous components from migrating into the environment and keep incompatible materials separate. The technical regulations set the maximum temporary storage time.
- Authorized final disposal. Non-radioactive hazardous waste may only be disposed of in security landfills authorized by MINEC. Disposal at unauthorized sites is a crime.
- Prior authorization to import recoverable materials. Anyone importing recoverable hazardous materials must obtain MINEC authorization before entry. Without it, the material is treated as hazardous waste and must be returned to its country of origin at the importer's expense.
What This Means for the Investor
Industrial reactivation will restart infrastructure and plants idle for years, fully or partially. Many will hold stored materials, accumulated residues, or improvised disposal sites that the law classifies as hazardous waste. Restarting operations without identifying and managing that preexisting situation creates liability. The former operator's liability does not exclude the new one's: whoever reactivates also assumes what it finds. Due diligence must therefore review the state of hazardous materials and waste on site.
The regime has implications at every stage. In due diligence, which must include a specific environmental assessment to identify the preexisting liabilities the new operator assumes. In project design, because waste management is part of the environmental impact study and the land occupation authorization that the regulations require. And in ongoing operation, because the registration, reporting, and emergency-plan obligations are permanent.
The practical conclusion: the project's legal team must work in coordination with the environmental consultant so that the hazardous materials regime is properly built into design, permits, and operation. A misstep here can compromise the project's viability and the investor's standing before lenders and partners.
Productive reactivation and environmental protection are complementary goals. Venezuela has the regulatory framework to achieve both. Knowing it is the first step to operating on solid ground.
